Privacy Policy

How we collect, use, store and disclose your personal information, and what to do if you have a concern.

Balanced Financial Management Pty Ltd (ABN 94 665 299 892) trading as Balanced Financial Management respects your privacy. This policy explains how we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

David Minehan (No. 1000437) and Balanced Financial Management Pty Ltd (No. 1297323) are Authorised Representatives of Newadvice Pty Limited, AFSL 546987. Where we provide financial services under that authorisation, Newadvice Pty Limited also handles your personal information, and their privacy policy applies alongside this one.

The information we collect

To give you financial advice we need to understand your circumstances. Depending on the advice you ask for, we may collect:

  • Identity details — name, date of birth, contact details, and identification documents we are required to verify under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006
  • Financial details — income, expenses, assets, liabilities, superannuation, insurance, investments, estate planning arrangements and tax position
  • Your objectives, risk tolerance and financial needs
  • Details of your family or dependants where these are relevant to your advice
  • Tax file numbers, where required for superannuation or taxation purposes
  • Health information, where you seek advice on life, trauma, total and permanent disability or income protection insurance

Health information and tax file numbers attract additional protection. We collect health information only with your consent and only where it is reasonably necessary to provide the advice or arrange the cover you have asked for. Tax file numbers are handled in accordance with the Privacy (Tax File Number) Rule 2015 and are never used to identify you for any other purpose.

How we collect it

We collect most information directly from you — in meetings, over the phone, by email, and through fact-find and application forms. Where you authorise it, we may also collect information from your superannuation fund, insurer, product issuer, accountant, solicitor, mortgage broker or another adviser.

If you contact us through this website, we collect only what you choose to send us. This site does not use advertising or analytics cookies.

Why we collect it and how we use it

We use your personal information to:

  • Understand your circumstances and prepare advice that is appropriate to them
  • Implement, review and monitor that advice over time
  • Apply for products on your behalf where you instruct us to
  • Meet our obligations under the Corporations Act 2001, the AML/CTF Act, taxation law and the conditions of our licensee's AFSL
  • Respond to your enquiries and administer our relationship with you

If you choose not to provide some of the information we ask for, we may not be able to give you advice, or the advice we give may be incomplete or inappropriate. We will tell you where that is the case.

Who we disclose it to

We disclose personal information only where it is necessary for the purposes above, where you have consented, or where the law requires it. That may include:

  • Newadvice Pty Limited, as our licensee, including for advice review and audit
  • Product issuers, superannuation funds, insurers and investment platforms where you ask us to arrange or vary a product
  • Paraplanning, administration and IT service providers who act for us under confidentiality obligations
  • Your accountant, solicitor, broker or other professional adviser, with your consent
  • Regulators including ASIC, AUSTRAC and the ATO, external dispute resolution schemes, and others where required or authorised by law

We do not sell your personal information, and we do not disclose it for marketing by third parties.

Overseas disclosure

Some of the software we use to run our practice — including document storage, email and client management systems — may store data on servers outside Australia. Where that occurs we take reasonable steps to ensure the provider handles your information consistently with the APPs.

Direct marketing

We may occasionally send you information about our services or about developments relevant to your circumstances. You can opt out at any time by contacting us, and we will action your request promptly and at no cost.

How we store and protect it

We hold records electronically and, where applicable, in paper form. We protect them with access controls, multi-factor authentication, encryption in transit, secured premises and staff confidentiality obligations. Records of the financial services we provide are generally retained for at least seven years, as required by the Corporations Act and the AML/CTF Act. When information is no longer needed and we are no longer required to keep it, we destroy or de-identify it.

Data breaches

If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner in line with the Notifiable Data Breaches scheme.

Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, and ask us to correct anything that is inaccurate, out of date or incomplete. Contact us using the details below. We will generally respond within 30 days. There is no fee for making a request, though we may charge a reasonable cost for providing access in some circumstances. If we decline a request, we will tell you why in writing.

Making a complaint

If you are concerned about how we have handled your personal information, please contact us first so we can try to resolve it. We will acknowledge your complaint promptly and aim to resolve it within 30 days.

If you are not satisfied with our response, you can refer the matter to the Australian Financial Complaints Authority, which is an approved external dispute resolution scheme for privacy complaints in financial services:
